Introduction

“INVEST-AZ Investment Company” CJSC (hereinafter referred to as “INVEST-AZ”, “us”, “we” or “our”) undertakes to comply with confidentiality, data protection measures, and the laws regarding the inviolability of private life.

What Does This Policy Regulate?

Dear User, while using this mobile application and the services we offer through it, the manner in which personal data obtained about you is used and protected is governed by this “Privacy Policy.”

This Privacy Policy applies to the data collected in the InvestAZ mobile application, and by registering in the mobile application you confirm your acceptance of its terms. In accordance with the requirements of the legislation of the Republic of Azerbaijan, “INVEST-AZ Investment Company” CJSC collects and processes only the personal data entered into the mobile application by you. By providing your personal data in the mobile application and confirming the agreement, you grant your consent to the collection and processing of such data by INVEST-AZ.

Definitions

  • Mobile Application – The InvestAZ mobile application, available via the App Store and Google Play, owned by “INVEST-AZ Investment Company” CJSC.
  • Personal Data – Any information that directly or indirectly enables the identification of an individual.
  • Collection of Personal Data – The lawful acquisition of personal data concerning an individual.
  • Processing of Personal Data – The operations performed on personal data (recording, systematizing, updating, modifying, retrieving, anonymizing, storing, transmitting, or deleting personal data).

1. Obligation to Protect Personal Data

Protecting the confidentiality of your personal data is one of our top priorities; accordingly, we have implemented the necessary technical and organizational measures. The personal data collected and processed by us is protected in accordance with applicable law. Please note that, in accordance with Article 5, Paragraph 2 of the “Law on Personal Data” of the Republic of Azerbaijan, your confidential personal data will not be disclosed to third parties except as provided by law or with your consent.

2. Sources of Data

The data collected about you is intended to provide you with the most appropriate and high-quality service and to improve our service levels. Such data is obtained in the following ways:

  1. Data Provided by You

    The data you enter while using the mobile application is collected by us. This personal data is provided entirely voluntarily. To ensure that we offer you high-quality and accurate service, you must provide all required information correctly and completely. Failure to provide the necessary data may render us unable to fulfill your request. You are responsible for the accuracy and completeness of the information provided. Inaccurate or incomplete information may affect the reliability of the service, our liability as an investment company towards you, and the service requirements. In such cases, INVEST-AZ bears no liability, and you are responsible for any resulting damages.

  2. Data Obtained from Other Sources

    For the purposes of organizing, regulating, and auditing our services, your personal data available on electronic information carriers of the relevant state authorities or the financial market supervisory body (and not prohibited from transmission by law) may also be collected.

3. Purposes for Which Data May Be Used

You consent to the use of your disclosed public and confidential personal data for the following (but not limited to) purposes:

  • To regulate contractual relations;
  • For market research, analytical purposes, and to improve processes, services, and products;
  • To inform you about our events, services, products, and innovations;
  • For the prevention and detection of fraud, money laundering, and the financing of terrorism;
  • To comply with any legal obligations (e.g., tax, accounting, and administrative obligations);
  • To fulfill the regulatory and supervisory functions related to investment company activities, in accordance with the written request of the financial market supervisory authority and during on-site inspections.

As INVEST-AZ, we may share your personal data (for the purposes outlined above and in accordance with applicable law) with the following third parties:

  • For service provision, your personal data may be transmitted by INVEST-AZ to state authorities, IT companies providing technical support, companies offering legal or other services, persons affiliated with INVEST-AZ, and other persons specified under the laws of the Republic of Azerbaijan;
  • To fulfill any legal obligations, including in the event of a complaint regarding the product or service provided to you, your data may be transmitted to the relevant supervisory authorities.

Privacy Policies of Third-Party Service Providers

The mobile application uses the following third-party service providers whose privacy policies are as follows:

  • Google Analytics for Firebase
  • Firebase Crashlytics

5. Links to Other Websites

This mobile application may provide links to other websites. INVEST-AZ is not responsible for the content or privacy policies of such websites. As other websites may have their own data collection practices and privacy policies, we recommend that you review the privacy policies of any third-party websites you visit.

6. Other Terms of Use

INVEST-AZ reserves the right to add, modify, or remove provisions of this Privacy Policy at any time without prior notice. Once such changes are made, by continuing to use the mobile application you accept the changes. INVEST-AZ will endeavor to regularly update the information presented in the mobile application; however, INVEST-AZ does not warrant the accuracy or completeness of the data entered by the User.

Except for direct damages resulting from intentional misconduct or gross negligence, INVEST-AZ shall not be liable for any direct or indirect damages arising from the use of the mobile application.

In accordance with the “Law on Personal Data” of the Republic of Azerbaijan, the User has the right to object to the collection and processing of their personal data. The User’s objection must be submitted to us in writing or through online procedures. No justification for the objection is required.
